Please read carefully before placing a reservation

1. Introduction. Experiencing adventures and what comes with it

SansaTravel specializes in travel, especially Wildlife safaris and cycling trips to Africa. SansaTravel has knowledge about safari parks, cycling routes, culture, local guides and transportation for the adventurous traveler.

 

Local customs can be different compared to your home country. Especially if they place high demands on punctuality, meeting appointments and comfort it can result in disappointments. Local technical capabilities are sometimes inadequate, for example for a timely repair of a vehicle or bicycle in a remote area. SansaTravel not always has control over such situations. However, SansaTravel always tries to make the best and most reliable choice when working with local assistants, transporters or guides.

 

 

SansaTravel requests the traveler for understanding and acceptance of this kind of restrictions. SansaTravel will always inform the traveler to the best of our ability, about such local restrictions.

 

The general conditions of SansaTravel are written from this outlined perspective. With the acceptance of these general terms and conditions, the traveler declares that he/she is aware of and agreed with that perspective.

2. Definitions

For these general terms and conditions, the following definitions apply:

1. SansaTravel, registered in the Trade Register of the Chamber of Commerce under file number 08073657, website www.sansatravel.com;

2. Travel Agreement: the agreement as stated and described in Sections 7: 500 up to and including 7: 513 of the Dutch Civil Code;

Traveler ("he" also read as "she"): the natural person with whom SansaTravel concludes an agreement or travel agreement.

3. Applicability

1. These general terms and conditions apply to all legal relationships between SansaTravel and the traveler regarding the (travel) agreement concluded for the benefit of the traveler.

2. Changes to these terms and conditions must be confirmed explicitly and in writing by SansaTravel.

3. If one or more stipulations in these general terms and conditions or in the agreement concluded are null and void or become void, the other provisions of these general terms and conditions and the agreement will continue to apply. In that case, the traveler and SansaTravel will consult with each other to agree on new provisions to replace the null and void or nullified provisions, taking into account as far as possible the purpose and intent of the original provisions.

4. Quotation, conclusion, and duration of the agreement

Quotations are always revocable due to changed availability and other external causes. For the rest, quotations are valid for two weeks after the issue date, unless otherwise indicated.

1. The prices in quotations include VAT unless otherwise indicated.

2. Obvious errors and mistakes in the website or (written) other information carriers of SansaTravel, such as brochures, advertising brochures and alike, cannot bind SansaTravel.

3. The offered price and further content of a quotation are only valid upon availability of the accommodations and any offered flights, on the understanding that the flights have always been checked by SansaTravel and are available for the offered rate at the time of the quotation. At time of the quotation, no options are taken on the accommodations or the flights, unless otherwise stated in the offer.

4. It is possible that one or more accommodations are no longer available at booking. If this is the case, SansaTravel will try to book an alternative, at least equivalent accommodation for the traveler, in close consultation with the traveler.

5. An agreement between SansaTravel and the traveler is established after acceptance within the validity period of the quotation, including the general terms and conditions, or after the acceptance to be equivalent thereto via the website of SansaTravel.

6. Local excursions, services, guides, etc., are only part of the (travel) agreement insofar as expressly included in the written booking confirmation. A reference to the possibility on site is not sufficient.

5. Preferences and essences

SansaTravel tries to accommodate to the best of our ability any special wishes (preferences) that are indicated at the time of booking. Whether that is successful or not depends on the eventual service provider, such as the hotel. In case a wish is so essential that a travel contract will only be concluded if it is certain that this wish is met, then there is an essence. Usually it concerns essences on medical grounds. The booking confirmation will then contain an indication, including the related surcharge.

6. Included / not included

Not included in the fare:

 

1. Travel taxes, visa fees, meals unless otherwise stated, wildlife park entry fees, rental (bicycle) equipment, surcharges for extra baggage (airlines), tips, expenses of personal nature (drinks, souvenirs etc.), any guide services unless included in the travel agreement, travel insurance, cancellation insurance, vaccinations.

2. The travel sum is always per person based on a shared double room. In some cases, it is possible to book a 3-person room. A 3-person room is almost always based on a double room with extra bed, usually a simple bed/mattress and does not always have the same quality as the main bed. A single room can be booked if possible, often at a surcharge

27. Change and location of the conditions

These conditions have been filed at the offices of the Chamber of Commerce office Apeldoorn, the Netherlands.

The last deposited version is applicable or the version that applied at the time of the conclusion of the present assignment.

7. Client / traveler details

1. The traveler is obliged to provide SansaTravel with all information and documents that SansaTravel requires for the correct execution of the trip in a timely manner and in the desired manner.

2. In addition, the traveler is obliged to supply on his own initiative all information to SansaTravel in good time of which the traveler knows, or reasonably should know, that it is, or maybe, important for the correct execution of the journey.

3. The traveler guarantees the correctness, completeness, and reliability of the information provided to SansaTravel, even if it originates from third parties.

4. SansaTravel has the right to suspend the execution or start of the journey until the moment the traveler has fulfilled these obligations. If the traveler does not comply with these obligations and the performance of the journey is delayed as a result, or if the information provided by the traveler does not comply with the provisions of paragraph 3, the resulting additional costs will be borne by the traveler.

8. Travel documents

1. The traveler is obliged to provide SansaTravel with all information and documents that SansaTravel requires for the correct execution of the trip in a timely manner and in the desired manner.

2. In addition, the traveler is obliged to supply on his own initiative all information to SansaTravel in good time of which the traveler knows, or reasonably should know, that it is, or maybe, important for the correct execution of the journey.

3. The traveler guarantees the correctness, completeness, and reliability of the information provided to SansaTravel, even if it originates from third parties.

4. SansaTravel has the right to suspend the execution or start of the journey until the moment the traveler has fulfilled these obligations. If the traveler does not comply with these obligations and the performance of the journey is delayed as a result, or if the information provided by the traveler does not comply with the provisions of paragraph 3, the resulting additional costs will be borne by the traveler.

9. Payment

Payment must take place within the deadline specified in the offer or agreement.

10. Cancellation and costs

1. If the traveler cancels the trip due to a personal circumstance, the traveler shall owe the following amounts in addition to any reservation costs due:

a. until the 56th day before the day of departure: the down payment;

b. from the 56th day until the 42nd day before the day of departure: 35%;

c. from the 42nd day until the 28th day before the day of departure: 50% of the travel sum;

d. from the 28th day until the 14th day before the day of departure: 75% of the travel sum;

e. from the 14th day until the 5th day before the day of departure: 90% of the travel sum;

f. from the 5th day up to and including the day before the departure day: 100% of the travel sum;

2. Single tickets: If a separate ticket is canceled by the traveler before the ticket is printed, € 115, - will always be charged, with the exception of tickets with different conditions. If the ticket is printed, the costs are 100% of the ticket costs.

11. Changes to essential and subordinate parts.

1. SansaTravel is entitled to change a (travel) agreement in essential parts due to weighty circumstances, communicated to the traveler without delay, for example when the originally planned trip cannot take place due to circumstances that SansaTravel does not control.

2. The traveler can reject the change. In that case, he will receive the travel sum or deposit refund.

3. SansaTravel is also entitled, in the event that relevant circumstances give cause to do so and promptly inform the traveler, of amending the (travel) agreement on subordinate parts. The traveler can only reject this change on subordinate parts if that change is to the detriment of more than minor significance.

4. SansaTravel may increase the travel sum up to 20 days before the start of the trip due to changes in transport costs, including fuel costs, the fees due or the applicable exchange rates.

5. The traveler may reject the price increase referred to in section 4. Unless otherwise stated, the agreement is considered to be canceled by SansaTravel. In that case, the traveler receives the travel sum or deposit refund.

6. The period within which the traveler can make use of his right to reject within the meaning of parts 2, 3 and 5 is 3 days. After that, that right applies as expired.

12. Cancellation by SansaTravel:

1. SansaTravel is entitled to terminate the (travel) agreement due to weighty circumstances communicated to the traveler without delay.

2. SansaTravel may be forced to cancel the (travel) agreement when participated by insufficient travelers. Insofar as SansaTravel wishes to reserve this right, SansaTravel will mention this in the agreement, stating the required minimum number of participants and the deadline for the notice of termination to the traveler.

3. SansaTravel may be forced to cancel the (travel) agreement due to disturbances of the traveler. In that case, any costs will be borne by the traveler.

4. In case of force majeure, SansaTravel may also be forced to terminate the (travel) agreement. In the event of force majeure, any abnormal and unforeseen circumstance that makes the journey or its progress practically impossible, obstructs it by objective standards, and / or involves danger for the traveler, arise independently of the will of SansaTravel and the consequences of which despite all reasonable precautionary measures taken by SansaTravel could not be prevented. Examples are war, natural disasters, strikes, negative travel advice and a cover restriction of the Calamity Fund.

5. SansaTravel is obliged to offer the passenger a different journey of equal or better quality in the event of cancellation as referred to in section 2 or 4.

6. If the traveler does not accept that offer, he is entitled to a refund or remission of the travel sum. If the trip has already been partially enjoyed: a proportionate part thereof.

7. In the event that SansaTravel terminates due to a circumstance to be attributed to SansaTravel, not being canceled due to insufficient participation or force majeure as indicated above, SansaTravel is obliged to compensate the traveler for his financial loss and an amount for loss of travel enjoyment.

8. SansaTravel will never be liable for higher compensation in respect of financial loss than three times the travel sum.

9. The compensation to be paid by SansaTravel due to lost travel enjoyment will be determined in fairness, however up to once the travel sum.

10. In the event that SansaTravel has offered the traveler an equivalent journey and the traveler has accepted that offer, SansaTravel's obligation to compensate for financial loss or loss of travel will lapse.

13. Conformity:

1. The content of the (travel) agreement concluded between SansaTravel and the traveler is determined by the expectations that the traveler may reasonably have on the grounds of the agreement. The information provided by SansaTravel is the starting point.

2. In the event that the trip does not meet the justified expectations of the traveler, SansaTravel is obliged to compensate the loss suffered by the traveler as a result, unless the shortcoming cannot be attributed to SansaTravel, nor to the auxiliary persons from whom SansaTravel uses in the execution of the agreement because:

a. Limitation in the performance of the travel contract is attributable to the traveler;

b. Limitation, which could not be anticipated or could be rectified, can be attributed to a third party who is not involved in the delivery of the services included in the trip;

c. Limitation is due to force majeure in the sense of these general conditions, or otherwise to an event that SansaTravel, or the person whose assistance SansaTravel uses in the execution of the (travel) agreement, with due observance of all possible care not could provide or remedy.

3. The maximum liability for damages of SansaTravel is three times the travel sum in respect of financial loss and once the travel sum in respect of lost travel.

4. Depending on the circumstances, SansaTravel is obliged to provide assistance and assistance to the traveler if the trip does not proceed in accordance with the expectations that the traveler could reasonably have on the grounds of the (travel) agreement.

5. In the event that the cause thereof must be attributed to the traveler, SansaTravel is only obliged to provide assistance and assistance insofar as this can reasonably be required from SansaTravel. In that case, the costs for the assistance and assistance provided will be borne by the traveler.

6. The costs of the assistance and assistance provided are borne by SansaTravel if limitation in the fulfillment is attributable to SansaTravel, or to the person whose assistance SansaTravel uses in the performance of the agreement, as referred to above in section 13.2

7. The passenger must complain as quickly as possible to SansaTravel and the service provider complains about the performance of the journey that the traveler has not agreed with his expectations, also to enable SansaTravel and the service provider to offer a solution as far as possible. The traveler must record his complaint on the spot in writing. Insofar as necessary, the traveler continues his complaint with further information and explanation to SansaTravel no later than one month after the end of the trip. This obligation of the passenger to inform SansaTravel and the service provider as soon as possible and as completely as possible, also to enable them to cancel or limit the shortcoming as far as possible, is essential.

14. Transport with airlines

1. In case SansaTravel uses airlines as a carrier, the proposal of SansaTravel and each specific offer from SansaTravel are based on the flight days and departure times of the various airlines as known at that time. In connection with any changes to the schedules, it may happen that SansaTravel is forced to change the itinerary and to adjust the program. Changes are therefore reserved. The traveler will receive the correct times with the travel documents.

2. The traveler must be present at the airport no later than 3 hours before departure unless otherwise stated in the booking.

3. SansaTravel accepts no liability for changes in the itinerary due to delays, etc. from airlines and any extra costs and/or adjustments to the program resulting from this.

4. For flights, the conditions of the respective airlines also apply in the relationship between SansaTravel and the traveler. This means, among other things, that:

a. any price increases and/or fuel surcharges, if applicable and imposed by the airline, will be charged;

b. changes in travel time may occur as a result of schedule changes imposed by the airline;

c. due to the failure of flights changes in the itinerary may occur, without SansaTravel being liable for this, to a greater extent than the airline.

15. Complaints concerning air carriers:

1. In case the passenger has a complaint about the air carrier, he shall always be obliged to report this complaint to the air carrier itself and to put it in writing. The traveler and the air carrier are in jointly par excellence the parties with the direct knowledge about possible failures and possible solutions.

2. The traveler shall also bear responsibility for the further settlement of that complaint with the air carrier.

3. SansaTravel will assist the traveler with information, documents and any statements in so far as SansaTravel is available or reasonably provided by SansaTravel.

4. Failure of this traveler's complaint responsibility shall be regarded as a shortcoming of the traveler.

16. Treaty and EU exclusions and limitations on liability.

1. Without prejudice to the above exclusions and limitations in any liability of SansaTravel, in the relationship between SansaTravel and the traveler every limitation and exclusion of liability as it is granted or permitted in applicable international conventions and EU regulations to carriers or other service providers.

2. Apart from future additions or amendments, which in that case must be considered as having been inserted here from the date of entry into effect, are currently applicable:

- the Warsaw Convention of 1929 on international air transport; - the Bern Convention of 1961 on rail transport; - the 1974 Athens Convention on maritime transport at sea;

- the Paris Convention of 1962 on the liability of hoteliers;

- the 1999 Montreal Convention for the Unification of Certain Rules for International Carriage by Air;

- EU Regulation number 889/2002 on air carrier liability in the event of accidents;

- EU Regulation No. 261/2004 on compensation and assistance to air passengers in the event of denied boarding and of cancellation or long delay of flights;

- EU Regulation 392/2009 on the liability of carriers of passengers by sea in the event of accidents.

3. The language or sites of these treaties and regulations are available on request via SansaTravel.

17. Compensation or exclusion in case of death or injury:

In the event that any liability for SansaTravel arises as a result of death or injury of the traveler, the permitted limitation of that liability in accordance with the applicable treaties, respectively (EU) regulations, or other (international) laws and regulations.

18. Other Liability

1. Unabridged the above and with the exception of what is stated explicitly there, SansaTravel will never be held to higher or other liability than up to three times the travel sum. This exclusion of (further) liability is only an exception for causes of damage due to SansaTravel's own actions or omissions, including the actions of employees of SansaTravel, which can be qualified as acts or omissions with the intent to cause the damage, or as reckless acting or omission with the knowledge that the damage would probably result.

2. SansaTravel shall not be held liable in the event that the traveler has been able to recover his / her damage from his travel or cancellation insurance, or the part thereof that is paid by the insurer.

19. Country information

SansaTravel advises the traveler to obtain information about the destination country prior to booking the trip and the trip. In addition to further information sources, SansaTravel is also available for more extensive information on time difference, language, currency, voltage, airport tax, climate, etc. (www.sansatravel.com / email: info@sansatravel.com). This information is not necessarily complete and does not bind SansaTravel.

20. Insurance

SansaTravel strongly advises the traveler to take out travel and cancellation insurance. SansaTravel also recommends the passenger to insure the medical expenses at the cost price. Our team can advise you on taking out appropriate travel- and cancellation insurance. We work together with Allianz Assintance, specialist in travel insurance and assistance.

21. Guarantee fund travel value foundation (SGR)

SansaTravel is affiliated with the SGR. Within the limits of the SGR guarantee scheme, the trips offered by SansaTravel are covered by the SGR guarantee. The SGR guarantee means that the traveler is assured that he will receive his prepaid travel money if his counterparty is unable to meet the agreed consideration due to financial inability. Insofar as the agreement also includes transport and the place of destination has already been reached, the return journey is taken care of.

22. Calamities / Calamity Fund

1. In the event of calamities in the destination area, including in any case natural disasters, nuclear reaction, war or a similar situation and riots using firearms with the aim to overthrow the existing authority, SansaTravel cannot be held responsible for any costs arising therefrom, loss of travel enjoyment, change or shortening of the travel program and ensuing costs, nor for costs related to repatriation.

2. To prevent (as much as possible) or limit the damage for the traveler, SansaTravel (KvK 08073657) is affiliated with the Stichting Calamiteitenfonds Reizen. € 2.50 per booking is paid to the Calamity Fund, with a maximum number of participants of 9 people per booking. Within the limits of the Calamity Fund's guarantee scheme, the trips published on this internet site are covered by the Calamity Fund's guarantee. This guarantee means that you, as a consumer who participates in a trip organized by SansaTravel:

a. (a part of) your travel sum will be refunded if SansaTravel is unable or unwilling to complete the journey as a result of a calamity;

b. necessary additional costs will be reimbursed if SansaTravel has to adjust the trip as a result of a calamity, or if SansaTravel has to repatriate the traveler early. By calamity is meant; an abnormal event caused by molestation or natural disaster.

23. Vaccinations

For information regarding vaccinations, SansaTravel refers the traveler to a general practitioner or health service.

24. Complaints

For information regarding vaccinations, SansaTravel refers the traveler to a general practitioner or health service.

25. Dispute resolution

1. The court in SansaTravel's place of business has exclusive jurisdiction to hear disputes unless provisions of imperative law dictate otherwise.

2. Parties will only appeal to the courts after they have made every effort to settle a dispute by mutual agreement.

26. Applicable law

Dutch law applies to every agreement between SansaTravel and the client.
